Shorter deadline for an unfair-dismissal claim in the contract – does it apply?
Likely invalid — such a clause does not bind you.
§ 4 KSchG gives the employee three weeks from receipt of a written termination to file an unfair-dismissal suit. Under § 7 KSchG, missing this deadline makes even a socially unjustified termination automatically valid. Contract clauses that shorten or obscure this deadline are void under § 13 (1) sentence 2 KSchG; the statutory three-week period applies.
