§561 BGB Sonderkündigungsrecht des Mieters nach Mieterhöhung
A tenant may terminate the tenancy extraordinarily at the end of the second month following after the landlord's notice of rent increase under § 558 or § 559, provided the tenant exercises this right within two months of receiving the notice; the rent increase does not take effect if the tenant terminates. (1) Macht der Vermieter eine Mieterhöhung nach § 558 oder § 559 geltend, so kann der Mieter bis zum Ablauf des zweiten Monats nach dem Zugang der Erklärung des Vermieters das Mietverhältnis außerordentlich zum Ablauf des übernächsten Monats kündigen.
