Terms of service (AGB)

5. Scope

These Terms of Service (AGB) govern the paid use of the lawcheck.io credit system operated by the provider named in the Impressum. They apply to consumers within the meaning of § 13 BGB and to entrepreneurs within the meaning of § 14 BGB.

2. Services

lawcheck.io provides an automated, machine-generated information service for residential rental contracts under German law. Each purchased credit entitles the holder to one full contract analysis, including the clause-by-clause risk overview and the shareable read-only link. The service is not legal advice — see the Haftungsausschluss for details.

3. Credits and prices

  • Credits are sold in fixed packs (see the Preise page). The prices shown are final prices and include the statutory German value-added tax (Umsatzsteuer) where applicable; the VAT is itemised on the invoice issued via Stripe.
  • Credits are tied to the purchaser's account, are not transferable, and do not expire.
  • One credit is consumed each time a contract analysis is submitted. If an analysis fails due to a technical error on our side, the credit is automatically refunded to the account balance.

4. Conclusion of contract

The display of credit packs on the pricing page does not constitute a binding offer. A binding contract is formed when the customer clicks "Buy" and completes payment on the Stripe-hosted Checkout page. The customer will receive a confirmation email from Stripe; lawcheck.io grants the purchased credits to the customer's account as soon as Stripe notifies us that the payment has succeeded (usually within a few seconds).

5. Payment

Payments are processed by Stripe Payments Europe, Ltd. (Dublin, Ireland). Accepted payment methods are displayed on the Stripe Checkout page and may include credit/debit cards and SEPA-based instruments. Card details are entered on Stripe's servers and never on lawcheck.io's infrastructure.

6. Withdrawal right (§ 355 BGB)

Consumer right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (see Impressum) by a clear statement (e.g. an email) of your decision to withdraw from this contract. You may use the model withdrawal form provided by the Federal Ministry of Justice, but it is not mandatory.

Expiration of the withdrawal right for digital content. Pursuant to § 356 (5) BGB, the withdrawal right expires early with respect to a contract for the delivery of digital content not supplied on a tangible medium if (1) the customer has expressly consented to the performance beginning before the withdrawal period expires, and (2) the customer has confirmed their awareness that this consent ends the right of withdrawal. Before completing a purchase on the Stripe Checkout page, the customer ticks a box confirming both.

Concretely: unused credits may be refunded at any time within 14 days by contacting support. Once the customer consumes any credit after the purchase, the withdrawal right lapses and a refund is no longer available. Consumed credits are never retroactively refunded.

7. Refunds

  • Technical failures on our side (pipeline error, extraction failure) automatically refund the credit to the account balance — no action required from the customer.
  • Within the 14-day withdrawal window, unused credits can be refunded to the original payment method via support. Partially used packs are refunded at the pack's unit price × remaining credits, minus any unrecoverable payment-processing fees.
  • Refunds are processed through Stripe and typically appear on the original payment method within 5–10 business days.
  • Refund requests must be submitted before account deletion. After deletion the user-side record is gone and refunds can only be processed at our discretion via Stripe's invoice archive.

8. Duties of the customer

  • Contracts uploaded for analysis must be lawfully held by the customer or used with the consent of all parties. Do not upload documents containing third-party personal data without a legal basis.
  • The customer is responsible for the security of their account credentials and for any activity carried out under their account.
  • Automated / bot-driven usage, scraping, resale of credits, or circumventing rate limits is prohibited.

9. Liability

Liability for financial losses arising from reliance on the automated analysis is limited to the extent permitted by law — see the full Haftungsausschluss. Liability for intent and gross negligence, for breach of material contractual duties, and under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

10. Data protection

Processing of personal data in connection with credit purchases — including all third-party service providers (payment processing, hosting, AI analysis) — is described in the Datenschutzerklärung.

When the customer deletes their lawcheck.io account, payment records are retained for 10 years pursuant to § 147 AO and § 257 HGB (tax-law retention). The records are de-linked from the deleted user account and can only be re-identified via Stripe's own invoice archive. This is permitted under DSGVO Art. 17 (2) (b).

11. Amendments

We may amend these terms to reflect changes in law or the service. Account holders will be notified of material changes by email no less than 30 days before they take effect. Continued use of the service after that date constitutes acceptance.

12. Applicable law, consumer arbitration

German law applies to the exclusion of the UN Convention on the International Sale of Goods (CISG). Mandatory consumer-protection rules of the customer's country of habitual residence remain unaffected. Place of jurisdiction is the provider's registered seat, to the extent permissible.

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
